Terms of Use
These Terms of Use ("Terms") are an agreement between you and the developer of Ambient ("we", "us") about your use of the Ambient app and any related services (together, "Ambient"). By downloading, opening or using Ambient, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Ambient.
1. Who can use Ambient
You must be at least 13 years old, and old enough to agree to these Terms where you live. If you are under 18, a parent or guardian must agree to these Terms for you and supervise any purchases.
2. What Ambient is — and is not
Ambient is a planning and time-management tool. It helps you lay out your day, see what's next, and run timers and reminders.
Ambient is not a medical device and does not provide medical, psychological or health advice. It does not diagnose, treat, cure or prevent ADHD or any other condition, and it is not a substitute for care from a qualified professional. Always talk to a doctor or other qualified professional about your health, medication and treatment.
Do not rely on Ambient for anything critical. Reminders, alarms, timers and widgets depend on your device, its operating system, battery-saving settings, Do Not Disturb, permissions and other things outside our control, and they may be late, silent or not appear at all. Do not use Ambient as your only reminder for medication, medical appointments, safety-critical tasks, legal or financial deadlines, or caring for another person. Ambient is not an emergency service; in an emergency, contact your local emergency number.
3. Your licence to use Ambient
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Ambient on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the app store you downloaded it from. We keep all other rights in Ambient, including its software, design, name and logo.
4. Your account
You need an account to use Ambient. When you create one, you agree to give accurate information, keep your password secure, and tell us promptly if you think someone else has accessed your account. You are responsible for activity under your account. You can delete your account at any time in the app (Settings → Account → Delete account).
5. Ambient Pro, subscriptions and payments
Some features require Ambient Pro, which you can buy as a subscription (for example monthly or yearly) or as a one-time lifetime purchase. Prices are shown in the app before you buy.
- Payment is handled by Apple (App Store) or Google (Google Play), not by us. Your purchase is also subject to their terms. We never see your card details.
- Subscriptions renew automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Your store account is charged within 24 hours before renewal.
- Free trials. If a trial is offered, you will be charged when it ends unless you cancel at least 24 hours before. As a courtesy we try to remind you two days before a trial converts, but that reminder is not guaranteed and you remain responsible for cancelling in time. Any unused part of a trial ends when you buy a subscription.
- Cancelling. Manage or cancel in your App Store or Google Play account settings. Cancelling stops future renewals; you keep Pro until the end of the period you've paid for.
- Refunds are handled by Apple or Google under their refund policies. Where the law gives you a right to a refund or to withdraw, that right is not affected.
- Lifetime means for as long as we offer and support Ambient Pro for your platform; it is not a guarantee that Ambient will be available forever.
- Price changes. We may change prices. Changes to a subscription apply from your next renewal, and the app store will notify you as required.
6. AI features
Ambient can turn a written or spoken "brain dump" into draft tasks. Depending on your settings, this runs on your device, on our server with an AI provider, or with a simple rule-based parser.
AI output can be wrong, incomplete or oddly timed. Always review suggested tasks before relying on them. Please don't enter information you wouldn't want processed this way, such as passwords, payment details or detailed health records. The optional on-device model is third-party software provided under its own open-source licence.
7. Your content
Your plans, tasks, routines and other content are yours. It stays on your device unless you choose to sync it to your account. You give us only the rights we need to process your content to provide the features you choose to use (for example, sending brain-dump text for AI processing). You are responsible for your content and for keeping your own backups; Ambient offers an export in Settings.
8. Acceptable use
You agree not to: break the law using Ambient; reverse-engineer, decompile or tamper with Ambient except where the law allows it; try to get around Pro purchases, usage limits or security; overload, attack or scrape our servers or AI features; use Ambient to create unlawful, harmful or abusive content; or resell or redistribute Ambient.
9. Third-party services
Ambient relies on services from others, including Apple, Google, RevenueCat (purchases), Supabase (accounts), an AI provider (server brain dump), Hugging Face (optional on-device model download) and your device's speech-recognition service. Those services have their own terms and we are not responsible for them.
10. Changes and availability
We may update, change or stop parts of Ambient, and we may update these Terms. If a change is material we will tell you in the app or by other reasonable means before it takes effect. If you keep using Ambient after the change takes effect, the new Terms apply. If you don't agree, stop using Ambient and, if you subscribe, cancel your subscription.
11. Ending these Terms
You can stop using Ambient at any time by deleting the app and, if you have one, your account. We may suspend or end your access if you seriously or repeatedly break these Terms, or if we must for legal reasons. Sections 2, 7 and 12 to 16 survive the end of these Terms.
12. Disclaimer
To the fullest extent the law allows, Ambient is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Ambient will be uninterrupted, error-free, or that reminders will always be delivered.
13. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, opportunities or goodwill, or for missed tasks, appointments, medication or deadlines, arising from your use of or inability to use Ambient. Our total liability for any claim relating to Ambient is limited to the greater of (a) the amount you paid us for Ambient in the 12 months before the claim arose, or (b) USD 50.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.
14. Indemnity
To the extent the law allows, you agree to cover our reasonable losses and costs arising from your breach of these Terms or your misuse of Ambient.
15. Governing law and disputes
These Terms are governed by the laws of the country in which the developer of Ambient is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts. Before starting any formal dispute, please contact us at jahnviaghera@gmail.com so we can try to resolve it informally.
16. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a right, we haven't waived it. You may not transfer these Terms without our consent; we may transfer them as part of a reorganisation or sale of Ambient. These Terms and the Privacy Policy are the whole agreement between you and us about Ambient.
17. Additional terms for Apple devices
If you downloaded Ambient from Apple's App Store:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Ambient and its content.
- Your licence is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
- Apple has no obligation to provide maintenance or support for Ambient.
- If Ambient fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for Ambient.
- We, not Apple, are responsible for handling any claims relating to Ambient, including product-liability claims, claims that Ambient fails to meet legal or regulatory requirements, and consumer-protection or privacy claims.
- We, not Apple, are responsible for investigating and handling any claim that Ambient infringes someone's intellectual property.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
